Terms of Service

Welcome to Kept. By using this site (the “Service”), you agree to these Terms. If you don't agree, please don't use the Service.

1. Who we are

Kept is a beta marketplace operated by an individual based in Middlesbrough, United Kingdom, focused on Teesside University students. Contact: hi@send.kept-tees.uk.

2. What Kept is (and isn't)

Kept is an intermediary platform that lets students list second-hand items and other students buy them. Kept is not the seller of the items. The contract for any sale is between the buyer and the seller.

3. Your account

• You must be at least 16 years old to use Kept.
• You must use an email address you control.
• You're responsible for activity on your account.
• We may suspend or close accounts that break these Terms, the law, or common decency.

4. Selling on Kept

• You must own what you list and have the right to sell it.
• Descriptions and photos must be accurate. Disclose damage, wear, missing parts honestly.
• You set the price. Kept may take a platform fee, disclosed clearly at the point of sale.
• You're responsible for any tax or duties on your sales (in most cases, casual second-hand sales are not taxable in the UK, but you should check your own situation).

5. Buying on Kept

• Items are sold as-is. Inspect at pickup. Once collected, the sale is final.
• If the item is materially different from the listing, refuse pickup and contact us.
• Pay only through Kept. Don't pay sellers directly.

6. Prohibited items

You may not list:

• Counterfeit, stolen, or otherwise unlawful goods
• Weapons, blades, ammunition, or imitation firearms
• Alcohol, tobacco, vapes, drugs, medication, or supplements
• Food or perishables
• Unsafe electrical items, including anything not PAT-tested or visibly damaged
• Adult / explicit material
• Anything that infringes someone's rights or breaches UK law

7. Pickup

Orders are collected from a designated pickup point. Pickup codes are single-use. Don't share them. If you don't collect within the stated window, the order may be cancelled and the item returned to sale.

8. Payments and refunds

Payments are processed by third-party providers. Kept does not store full card details. Because items are sold as-is and final on collection, Kept does not offer general refunds. If something goes seriously wrong (item never delivered, item materially misdescribed and refused at pickup), contact us and we'll mediate.

9. Content you post

You retain ownership of the photos and text you upload. You grant Kept a worldwide, royalty-free licence to host, display, resize, and translate that content for the purpose of running the Service.

10. Acceptable use

Don't:

• Harass, threaten, or discriminate against other users
• Scrape, automate, or otherwise abuse the platform
• Try to defeat security, rate limits, or auth systems
• Impersonate other users or businesses

11. Liability

Kept is provided on an “as is” basis. To the maximum extent permitted by law, Kept is not liable for indirect or consequential loss. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be excluded by UK law.

12. Changes to these Terms

We may update these Terms. We'll change the “Last updated” date at the top. Material changes will be notified by email or an in-app notice.

13. Governing law

These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
